Stat Holiday Pay Eligibility

Statutory holidays generally mean that employees are not required to work and are entitled to pay for these days off. Most employees can receive statutory holiday pay if they adhere to the “first and last rule” and the Ontario Employment Standards Act regulates their workplace.

To qualify for statutory holiday pay in Ontario, an employee must have worked their last scheduled shift before the holiday and their first shift after the holiday, or have a valid reason for missing these shifts.

Stat Holiday Pay Calculation

To calculate an employee’s holiday pay in Ontario, sum up their regular hourly wages for the four work weeks preceding the holiday and divide by twenty. Add the total vacation pay due for those four weeks. This method simplifies the calculation for employees with fixed wages.

In addition to statutory holiday pay, employees who work on statutory holidays in Ontario are entitled to premium pay. This is calculated by multiplying the number of hours worked by 1.5 times the regular hourly rate. For each hour worked on a public holiday, the employee must receive 1.5 times their normal pay.
